On May 24, 2022, the Western District of Texas, Austin Division granted Defendant Allstate Fire and Casualty Insurance Company’s (“Allstate”) motion for summary disposition filed by Greg Wilkins and Julia Matheny.
This case concerned Allstate’s purported obligations to indemnify an insurance policyholder against whom the claimant has received a default judgment resulting from a personal injury occurrence. The court ultimately held that the claimant failed to meet his burden to establish the existence of genuine material fact. The court rendered final judgment in favor of Allstate. See Hernandez v. Allstate Fire & Cas. Ins. Co., No. 1:20-CV-1132-RP, 2022 WL 2902841, at *5 (W.D. Tex. May 24, 2022).
